Subject: 9636/1991-079 Chattanooga Auth Date: Mon, 27 Feb 1989 12:20:00 -0500 1991-079 Chattanooga Housing Authority ORDINANCE NO. 9636 AN ORDINANCE CLOSING AND ABANDONING OLD DODSON AVENUE LOCATED NORTHEAST FROM DODSON AVENUE, NORTHEAST OF MILNE STREET, AND OLD WINDSOR STREET LOCATED SOUTHEAST FROM DODSON AVENUE, NORTHEAST OF MILNE STREET, MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned Old Dodson Avenue located northeast from Dodson Avenue, northeast of Milne Street, and Old Windsor Street located southeast from Dodson Avenue, northeast of Milne Street, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: Part of Old Dodson Avenue (also known as Harrison Avenue and Boynton Avenue), a 50 foot wide unopened right-of-way, and part of Old Windsor Street, a 50 foot wide unopened right-of-way. Said parts of streets begin on the southeast line of Dodson Avenue some 100 feet northeast of the intersection of the southeast line of Dodson Avenue with the northeast line of Milne Street, thence northeast and northwest some 160 feet with Dodson Avenue to the northwest line of Old Dodson Avenue, thence with Old Dodson Avenue northeast some 145 feet, and northwest 6.6 feet to the southwest line of Old Windsor Street, thence northwest some 66 feet with Old Windsor Street to the northeast line of Dodson Avenue, thence northwest some 55 feet with Dodson Avenue to the northeast line of Old Windsor Street, thence southeast some 40 feet with Old Windsor Street to the southwest line of Old Dodson Avenue, thence northwest some 50 feet with Old Dodson Avenue to the southeast line of Windsor Street, thence northeast and southeast some 61 feet with Windsor Street to the northeast line of Old Dodson Avenue; thence with Old Dodson Avenue southeast 121 feet, and southwest 315 feet to the southeast line of Dodson Avenue, the point of beginning. Said part of Old Dodson Avenue separates lots 1-8, block 15, Woodlawn Subdivision, as shown by plat of record in plat book 2, page 3, R.O.H.C., from part of lot 8, block 10, and lots 7-9 and part of 10, block 11, Missionary Heights Addition, as shown by plat of record in plat book 5, page 29, R.O.H.C. Said part of Old Windsor Street separates part of lot 8, block 10, from part of lot 7, block 11, said Missionary Heights Addition. Tax Map No. 146D-D-1-2 and 26-28. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The Electric Power Board of Chattanooga has distribution facilities located within said right-of-way which must be maintained for the use and benefit of its customers and an easement the width of the entire right-of-way is reserved for the operation, maintenance, rebuilding, and replacement of these distribution facilities. 2. The reservation for the Tennessee-American Water Company of an easement the width of the right-of-way for the purpose of operating and maintaining their facilities located within the right-of-way. 3. The City of Chattanooga has a sewer located within said right-of-way and reserves an easement the width of the right-of-way for the purpose of maintaining said sewer. 4. The resubdivision of adjacent property to be approved by the City Traffic Engineer so as to prevent any land-locked parcels. 3. The areas reserved for utility easements must be kept free and clear of all structures. 4. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
